Charges dismissed against alleged Flint church rapist after victim fails to show up to court

FLINT, MI — Sexual assault charges against a man accused of attacking one woman and attempting to attack another at a downtown Flint church have been dismissed after the victim failed to show up to court, authorities say.

Albert E. Haymer, 49, of Flint, was charged with one count of first-degree and one count of second-degree criminal sexual conduct after authorities say he sexually assaulted one woman and attempted to assault another one at the First Presbyterian Church of Flint on March 27.

Haymer was scheduled to be in Flint District Court on Monday for a preliminary hearing on the charges.

However, Genesee County Prosecutor David Leyton said the victim in the case, who authorities say is homeless, did not show up to the court date, which allowed the sexual assault charges to be dismissed on a motion from Haymer's attorney, Major White.

The charges were dismissed without prejudice, meaning Leyton could refile the charges in the future.

"We want to prosecute," said Leyton.
